1. General and application of the terms

These terms of use govern browsing and use of the brand website of the Kostilatas mineral water brand (hereinafter: "the Website"), whose address is https://kostilatas.co.il. The Website is operated by BARA IMPORTERS LTD, company no. 515537801 (hereinafter: "the Website Operator").

The very entry to the Website, browsing it or using its contents constitutes full and unreserved agreement to these terms. Anyone who does not agree to the terms of use may not use the Website. For the avoidance of doubt, these terms are written in the masculine form for convenience only and refer to all genders alike.

The Website is a brand and sales-promotion website for presenting the brand and information about it, and does not constitute an online store. No online purchase, clearing or payment is carried out on the Website. Orders, price inquiries and coordination of supply are made directly with a representative, through the contact form on the Website or by telephone (03-5117074). The engagement for the purchase of products is concluded with the representative, and the payment methods are agreed directly with him.

2. Ownership and intellectual property

All the content displayed on the Website, including texts, design, structure, graphics, illustrations, photographs, videos, color scheme, source code, logo, brand name and trademarks, is protected by copyright and other laws, including the Copyright Law, 5768-2007.

• All rights in the content are reserved to the Website Operator or to its licensors, and granting access to the Website does not grant any right in them.
• The brand name, the logo and the trademarks of Kostilatas are protected. No use whatsoever may be made of them without prior written approval from the Website Operator.
• Any mention of brands, names or third parties, to the extent that there is any, is made for identification purposes only and does not confer any right or attest to any connection.

3. Permitted use and prohibited use

Access to the Website is granted for personal, private, non-commercial use in good faith, in accordance with these terms and the provisions of any law.

It is prohibited, among other things:

• To copy, duplicate, distribute, publish, modify, create derivative works from, commercialize or publicly display any of the content of the Website, in whole or in part, without prior written permission.
• To use automated tools for collecting or scraping information, including robots, crawlers and other content-mining software.
• To reverse engineer, break into or attempt to break into the Website's systems, to place an unreasonable load on the server, or to harm the integrity, availability or security of the Website.
• To make use of the Website that is unlawful, infringes rights, is offensive or misleading, or is liable to harm a third party.

Certain actions among those listed above may amount to an offense under the Computers Law, 5755-1995, or under other law.

4. The nature of the information and the absence of health claims

The content on the Website is intended only for presenting the brand and conveying general information. The information about the product, its source, composition and properties is presented in a factual and descriptive manner.

• The brand's products are mineral drinking water. They are not a medicinal preparation, are not a dietary supplement and are not intended for the treatment, prevention, diagnosis or cure of any medical condition.
• Nothing in the information displayed on the Website attributes healing properties or a health effect to the product, and it is not to be regarded as medical, nutritional or other professional advice.
• Composition and property data, including mineral values, are given subject to laboratory certificates and the binding nutritional labeling on the product, which are the determining source.
• The product images, its coloring and the manner of its presentation on the Website are for illustration only and are not binding with regard to the actual appearance of the packaging or the product at the points of sale.

5. Importer, manufacturer and labeling details

The product is manufactured in Greece and marketed in Israel by the importer. The details of the manufacturer and the importer, as required by food labeling laws, are as follows:

• Original manufacturer: Kostilatas Springs SA, Epirus, Greece.
• Importer in Israel: BARA IMPORTERS LTD, company no. 515537801, 7 Yitzhak Rabin St., Kadima-Zoran, postal code 4282300.
• Nutritional labeling, mineral composition and kashrut information, to the extent that they exist, appear on the product packaging and are the binding source in this regard.

A deposit applies by law to beverage containers of a volume of 0.1 to 5 liters, in accordance with the Deposit on Beverage Containers Law, 5759-1999. The deposit details are stated on the container.

6. Limitation of liability and disclaimer

The Website and its contents are provided as they are and as available, without any representation or commitment of any kind, express or implied.

• The Website Operator does not undertake continuous availability of the Website, the absence of faults, errors, viruses or harmful components, or the accuracy, currency and completeness of the information displayed on it.
• Use of the Website and its contents is at the sole responsibility of the user. The Website Operator shall not be liable for any direct, indirect, consequential or special damage arising from the use of the Website or from the inability to use it, to the extent permitted by law.
• This limitation of liability does not derogate from liability that cannot be limited or conditioned by law, including liability for bodily injury caused maliciously or negligently, and liability under the Defective Products (Liability) Law, 5740-1980.

7. Information security and third-party platforms

The Website Operator implements reasonable and customary security measures with respect to the Website under its direct management. However, online activity is not completely immune, and absolute protection cannot be guaranteed.

• The Website relies on third-party platforms and services, including hosting, domain and infrastructure services. The Website Operator is not responsible for security incidents, breaches, leaks, outages or failures originating in third-party platforms or their infrastructures.
• The user must take reasonable precautions with respect to the devices and accounts under his control.

8. Links to third-party websites and services

The Website may include links to third-party websites and services. The Website Operator does not control this content and is not responsible for it, and a mention or link is not a recommendation or approval. The responsibility and the terms applicable to third-party websites are those of their operators alone, and it is recommended to review their terms of use and privacy policies.

9. Inquiries and mailings

To the extent that the Website includes the option of making contact or signing up for updates, the provision of details is done at the user's own will. Sending an advertisement by e-mail or by other digital means will be done only subject to explicit prior consent and in accordance with Section 30A of the Communications (Telecommunications and Broadcasting) Law, 5742-1982, and removal from the mailing list will be possible at any time.

The collection of personal information and its use, to the extent that they are carried out on the Website, are subject to the Website's privacy policy and to the provisions of the Protection of Privacy Law, 5741-1981, as amended.

11. Amendment of the terms

The Website Operator may update these terms from time to time, at its discretion and subject to the law. The binding version is the version published on the Website at the time of use. Continued use of the Website after an update constitutes agreement to the updated terms. It is recommended to review the terms from time to time and to note the date of the latest update shown at the top of the document.

12. Governing law and jurisdiction

These terms and the use of the Website shall be governed solely by the laws of the State of Israel. The exclusive jurisdiction in any matter relating to these terms or to the use of the Website shall be vested in the competent courts in the Central District, and in them alone.

To the extent that a user accesses the Website from another country, mandatory consumer protection rules applicable at his place of residence may apply to him, and they are not necessarily displaced by the jurisdiction clause above.
